The First 60 Seconds โ Safety First
Take a breath and check yourself and any passengers for injury before doing anything else. Adrenaline masks pain โ if there's any doubt, sit still for 30 seconds and mentally scan neck, back, and head before you move.
If the vehicles are drivable and you're on a freeway or busy surface street, California Vehicle Code 20002 actually encourages you to move to the shoulder or nearest safe location to prevent secondary collisions. If any vehicle is undrivable, turn on hazards, set up flares or triangles if you have them, and get everyone behind a barrier away from traffic.
When to Call 911 vs. the Non-Emergency Line
Call 911 immediately if anyone is injured, if a vehicle is blocking traffic, if the other driver is impaired or aggressive, or if the other driver flees the scene. Injury accidents in California legally require a police response.
For property-damage-only accidents on a surface street, most Orange County agencies (Santa Ana PD, Anaheim PD, CHP, Orange County Sheriff) will direct you to file a counter report the same day rather than dispatch an officer. Ask dispatch โ get their answer in writing (a call reference number) either way.
What to Photograph โ All of It
Take more photos than you think you need. Modern claims are largely decided by pictures.
Photograph: all damaged vehicles from all four corners, close-ups of every dent and scrape, both license plates, the other driver's insurance card and driver's license, the VIN plate through the windshield of both cars, skid marks, debris fields, traffic signals and stop signs relevant to the intersection, the position of the vehicles before they're moved (if safe), and any visible injuries.
Also take a short video panning the entire scene. Video captures context โ lane markings, signal timing, weather, lighting โ that individual photos miss.
Information You Must Exchange
California Vehicle Code 16025 requires drivers to exchange: full name and current address, driver's license number, vehicle registration number, name and address of the vehicle's registered owner if not the driver, and the name and policy number of their liability insurer.
You do not have to discuss fault. Don't apologize, don't say 'I didn't see you,' and don't say 'I'm fine' if you might not be. All three of those statements are commonly used to reduce a claim later. A polite 'Let's exchange information and let our insurance companies handle it' is the right script.
Witnesses โ Get Them Before They Leave
Independent witnesses are gold in disputed-fault claims. Ask anyone who stopped for their name and phone number. A witness who is willing to give a two-sentence recorded statement to your insurer within 24 hours can be the difference between a 100% payout and a comparative-fault reduction.
Report to Your Insurance Company Quickly
Call your agent or your carrier's claims line the same day, even if you think the accident was minor and even if you think it wasn't your fault. Most policies require prompt notice, and delayed reporting is a common reason claims are contested.
You are only required to give your carrier the facts of what happened. You are NOT required to give a recorded statement to the OTHER driver's insurance company. If you're contacted by the at-fault driver's adjuster, tell them politely that all communication should go through your agent, and forward their contact info to your agent.
SR-1 Report to the DMV
California requires drivers to file an SR-1 form with the DMV within 10 days of any accident involving injury, death, or property damage over $1,000. Your insurance company usually files it for you, but confirm โ the driver is legally responsible for the filing, not the carrier.
Get Medical Attention Even If You Feel Fine
Soft-tissue injuries, whiplash, and concussion symptoms often don't appear until 24โ72 hours later. A same-day urgent care or ER visit does two things: it protects your health, and it creates a medical record tied to the date of loss. Without that record, an adjuster can argue any later injury isn't related.
